Clearance Hub โ Terms and Conditions
Last Updated: 13 October 2026
1. Introduction
Welcome to Clearance Hub.
Clearance Hub (โweโ, โusโ, โourโ or โthe Platformโ) operates an online marketplace that allows retail stores and businesses to advertise and list clearance products for customers to discover.
Clearance Hub is based in Sydney, New South Wales, Australia.
These Terms and Conditions govern your access to and use of our website, including browsing product listings, registering a store account, publishing clearance listings and contacting retailers.
By accessing or using Clearance Hub, you agree to these Terms and Conditions. If you do not agree, you must not use the Platform.
If you register a store account, you confirm that you are authorised to accept these Terms on behalf of yourself or the business you represent.
2. Our Role as a Listing Platform
Clearance Hub provides an online platform for stores to advertise clearance products and for customers to discover those products and contact the relevant stores.
Clearance Hub is a listing and discovery platform only.
Unless expressly stated otherwise in writing:
- Clearance Hub does not own, purchase, stock, sell or resell the products listed on the Platform.
- Clearance Hub is not the seller, manufacturer, distributor or supplier of listed products.
- Clearance Hub does not act as the payment processor, sales agent or fulfilment provider for transactions between customers and stores.
- Clearance Hub does not take a commission on product sales.
- Customers deal directly with the relevant store regarding product enquiries, purchases and any arrangements following an enquiry.
- Stores are responsible for their products, listings, prices, stock availability, sales transactions and fulfilment.
A listing on Clearance Hub does not mean that we have inspected, tested, approved, certified or independently verified the product or the retailer.
We may review, moderate or remove listings, but doing so does not constitute a guarantee of their accuracy, quality, safety or legitimacy.
3. Customer Use of the Platform
Customers may browse clearance listings, compare products and contact stores using the contact information or enquiry facilities available on the Platform.
Before making a purchase or paying any money, customers should independently contact the store and confirm:
- The product is still available.
- The current selling price and any additional charges.
- The product's condition, including whether it is new, ex-display, open-box, refurbished, returned or damaged.
- The product specifications, dimensions, features and suitability.
- Whether the product has been inspected and whether any defects exist.
- The applicable warranty, return, refund and exchange arrangements.
- Delivery, collection, installation and associated costs.
- The retailer's identity and the payment method being requested.
Product listings may become outdated, and products may sell out or be withdrawn without notice.
Customers are responsible for making informed purchasing decisions. We recommend inspecting products in person where practical, particularly floor stock, ex-display, open-box and damaged items.
Do not rely solely on a listing as confirmation that a product remains available or that its description, condition or price is accurate. Confirm all material details directly with the retailer before paying.
4. Purchases, Payments and Fulfilment
Clearance Hub does not collect or process payment for products on behalf of stores unless a separate written agreement expressly provides otherwise.
Customers pay the relevant retailer directly using a payment method agreed between them.
The retailer is responsible for:
- Accepting and processing customer orders.
- Providing accurate payment instructions and receipts.
- Confirming payment and product availability.
- Arranging collection, delivery, installation or other fulfilment.
- Meeting applicable product safety and consumer law requirements.
- Managing customer complaints, returns, refunds, exchanges, repairs and warranties.
- Communicating any changes to price, availability or fulfilment arrangements.
Clearance Hub does not arrange or guarantee delivery, collection, installation, product availability, refunds or fulfilment.
Customers should verify payment details directly with the retailer using independently confirmed contact information. Customers should exercise caution if asked to transfer money to an individual or an account that does not appear to belong to the retailer.
5. Retailer Responsibilities
Stores and retailers using Clearance Hub (โRetailersโ) must ensure that they are legally entitled to advertise and sell the products they list.
By creating an account or publishing a listing, Retailers agree to:
- Provide accurate and current business contact details.
- Ensure that product titles, descriptions, photographs, prices and stock information are accurate and not misleading.
- Clearly disclose the product's condition, including any defects, damage, missing parts or packaging issues.
- Have the right to sell the advertised products and use all uploaded photographs, logos and other content.
- Ensure that advertised products comply with applicable Australian laws, product safety standards and mandatory recall requirements.
- Honour any price, availability, warranty or other representations made to customers, subject to applicable law.
- Deal directly and fairly with customers regarding purchases, payments, complaints, returns and fulfilment.
- Update or remove listings promptly when products are sold, unavailable or no longer offered.
- Avoid listing counterfeit, stolen, prohibited, recalled or unlawfully obtained products.
- Not publish misleading, deceptive, fraudulent, defamatory, discriminatory or unlawful content.
- Not use the Platform to distribute spam, malware or harmful content.
- Comply with applicable privacy, consumer protection, product safety and advertising laws.
Retailers must not use Clearance Hub to misrepresent ordinary pricing as a discount or to make false claims about a product's original price, savings, condition or availability.
Clearance Hub may request supporting information, amend or remove a listing, suspend an account or terminate access where a Retailer breaches these Terms or where we reasonably consider action necessary to protect users or comply with the law.
6. Store Registration and Accounts
Retailers may be required to register an account before listing products.
Retailers must provide complete, accurate and up-to-date registration information and maintain the confidentiality of their login credentials.
Retailers are responsible for activities carried out through their accounts, except to the extent applicable law provides otherwise.
Retailers must notify Clearance Hub promptly if they suspect unauthorised access or misuse of their accounts.
We may refuse, suspend or terminate an account where registration information is false, fees remain unpaid, these Terms are breached or continued access presents a reasonable legal, security or operational risk.
7. Listing Fees and Charges
Clearance Hub charges Retailers fees for listing products or accessing specified listing services.
The applicable fee structure, listing duration, payment terms and any other charges will be communicated to the Retailer during registration, subscription or purchase of the relevant listing service.
Our business model is based on listing fees rather than commissions on product sales.
Accordingly:
- Clearance Hub does not charge a percentage commission on sales made between Retailers and customers.
- Retailers remain responsible for paying the agreed listing fees regardless of whether a listing results in an enquiry or sale, subject to the applicable fee terms and consumer law.
- Listing fees do not guarantee enquiries, sales, leads, website traffic or a particular commercial outcome.
- Retailers must review the applicable pricing and listing terms before purchasing a listing service.
- Any cancellation, renewal, credit or refund of listing fees will be handled in accordance with the applicable fee agreement and Australian law.
We may change our fees for future listings or renewal periods by providing reasonable notice. A fee change will not retrospectively alter a fee already paid for a completed listing period unless agreed or required by law.
Where applicable, prices will state whether GST is included or payable in addition.
8. Product Listings and Content
Retailers retain responsibility for the products and content they submit.
By submitting content to Clearance Hub, Retailers grant us a non-exclusive, royalty-free licence to host, reproduce, display, format and promote that content as reasonably necessary to operate, maintain and market the Platform and the relevant listings.
This licence continues for as long as reasonably necessary to provide the service, subject to applicable law and any required removal of content.
Retailers confirm that they own or have permission to use the submitted content and that its use does not infringe another person's rights.
Clearance Hub may resize images, adjust formatting, organise categories or make other reasonable presentation changes without materially misrepresenting a product.
We may remove content that breaches these Terms, infringes rights, appears misleading or creates legal, security or reputational risks.
9. Product Information and Third-Party Retailers
Product listings are provided by independent Retailers. Clearance Hub does not guarantee that a listing is complete, accurate, current or suitable for a customer's needs.
We do not guarantee the quality, condition, authenticity, safety, legality, ownership, availability or performance of any listed product.
Any discussion, negotiation, agreement, payment or transaction between a customer and a Retailer is between those parties.
Retailers are responsible for complying with consumer guarantees, refund obligations, warranty promises and other applicable legal requirements. Nothing in these Terms removes any consumer rights that cannot lawfully be excluded.
10. Complaints and Disputes
Questions about a product, payment, delivery, collection, return, refund, repair or warranty should first be directed to the Retailer that listed or sold the product.
Clearance Hub is not a party to transactions between customers and Retailers and is not responsible for resolving those transactions.
However, we may, at our discretion, receive reports about listings or account conduct, request information, remove listings or suspend accounts where appropriate.
We do not guarantee that we will investigate, mediate or resolve every complaint, and any assistance we provide does not make us the seller of the product.
Nothing in this section limits any rights or remedies available under applicable law.
11. Intellectual Property
The Clearance Hub name, branding, website design, software and other Platform materials may be protected by intellectual property laws.
You must not copy, reproduce, modify, distribute or commercially exploit our intellectual property without prior written permission, except as permitted by law.
Retailers must not upload material that infringes the intellectual property or other rights of third parties.
12. Website Availability and Security
We aim to keep Clearance Hub available and functioning, but we do not guarantee uninterrupted, error-free or secure access at all times.
We may temporarily suspend, modify, update or discontinue parts of the Platform for maintenance, security, technical, operational or business reasons.
Users must not attempt to gain unauthorised access, interfere with the Platform, introduce malicious software or use automated methods to extract data without our permission.
13. Limitation of Liability
To the maximum extent permitted by law, Clearance Hub excludes liability for losses arising from:
- The acts, omissions or conduct of Retailers or customers.
- The accuracy, completeness, availability, condition, quality, safety or legality of listed products.
- Transactions, payments or agreements between customers and Retailers.
- Delivery, collection, installation, returns, refunds, repairs or other fulfilment arrangements.
- Fraud, misrepresentation or disputes involving a Retailer or customer.
- Website interruptions, technical issues, unauthorised access or events beyond our reasonable control.
Clearance Hub does not guarantee that any listing will lead to a sale or that any Retailer or customer will perform their obligations.
To the extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the Platform.
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded or limited.
Where liability cannot legally be excluded, it is limited only to the extent permitted by applicable law.
14. Indemnity
To the extent permitted by law, Retailers agree to indemnify Clearance Hub against reasonable losses, claims, liabilities, costs and expenses arising from their breach of these Terms, unlawful listings, infringement of third-party rights or dealings with customers.
This indemnity does not apply to the extent that a loss is caused by Clearance Hub's own unlawful conduct or other circumstances for which the Retailer cannot legally be held responsible.
15. Privacy
Your use of Clearance Hub is also governed by our Privacy Policy, which explains how we collect, use, store and disclose personal information.
By using the Platform, you acknowledge that you have had the opportunity to read the Privacy Policy.
Where consent is legally required, we will obtain it before undertaking the relevant activity.
16. Changes to These Terms
We may update these Terms from time to time.
The updated version will be published on the website with a revised โLast Updatedโ date. Where required by law or where a material change affects an existing paid service, we will provide appropriate notice.
Your continued use of the Platform after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree to the updated Terms, you should stop using the Platform and, if applicable, follow the relevant account cancellation process.
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them, subject to any applicable consumer rights or mandatory legal requirements.
